HIV AND AIDS ACT=20 2006

Regulations made by = the Minister=20 under section 20 of the HIV and AIDS Act 2006

1. =20 These regulations may be cited as the HIV and AIDS = (Collection,=20 Storage and Disposal of Used Syringes and Needles) Regulations 2007. =

2. =20 In these regulations -

"Act" means the HIV and AIDS Act 2006.=20

3. =20 Any used syringe and needle collected by an institution or = organisation,=20 prescribed under section 14 of the Act, from an injecting drug user or = as part=20 of the syringe and needle exchange programme, shall be placed = immediately in=20 disposal containers, which shall be resistant to puncture and of a = capacity of=20 not less than 5 litres.

4. =20 Any disposable container referred to under regulation 3 shall be = properly=20 sealed and transported on the same day of collection to any such place = as may be=20 designated by the Senior Chief Executive, for storage under lock and key = pending=20 incineration.

5. =20 The incineration of containers referred to in regulation 4 shall = be=20 carried out under the supervision of an officer of the Ministry = designated by=20 the Senior Chief Executive.

6. =20 A prescribed institution or organisation shall submit a weekly = return to=20 the Ministry, specifying the number of syringes and needles distributed = and=20 collected daily.

7. =20 (1) = Any=20 institution or organisation which contravenes these regulations shall = commit an=20 offence and on conviction maybe liable to a fine not exceeding 25,000 = rupees.=20

(2) = The=20 Court may, in addition to the sentence specified under paragraph (1), = order that=20 the institution or organisation be removed from the list of prescribed=20 institutions or organisations.

8. =20 Where the = Permanent=20 Secretary is of the view that a prescribed institution or organisation = has=20 contravened

these regulations, = he may=20 remove the institution or organisation from the list of prescribed = institutions=20 or organisations, pending the determination of the case. =
